THIS CONTEST IS INTENDED FOR PLAY IN THE 50 UNITED STATES & D.C. ONLY & WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE OR LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.
Eligibility: The Camp Hyatt On Assignment Contest ("Contest") is open to legal residents of the 50 United States & the District of Columbia ("D.C.") who are between the ages of 6 & 12 as of the date of entry. Entrants must have a parent’s or legal guardian’s permission to participate in this Contest prior to entering. Children of employees, officers, directors, agents & representatives of Hyatt Corporation ("Sponsor"), Taylor Global, Inc., & each of their respective parent companies, affiliates, hotels, distributors, suppliers, subsidiaries, & advertising & promotion agencies (collectively "Released Parties") & any such individual's immediate family members (mother, father, sister, brother, daughter, son & their respective spouses, regardless of where they reside) & those living in their same households, whether or not related, are not eligible to participate or win. Void where prohibited by law. This Contest is subject to all applicable federal, state & local laws.
To Enter: 1) Online: Visit camphyattonassignment.com between 12:00:01AM Eastern Time ("ET") on 7/23/09 & 11:59:59PM ET on 9/4/09 ("Promotion Period") & click on the Contest link. Follow the instructions provided to complete & submit the pre-registration form including your first name & your parent's or legal guardian's email address ("Entry Information"). Following submission of your Entry Information, your parent or legal guardian will promptly be sent a confirmation email requesting his/her consent for you to enter this Contest. To provide consent for you to enter, your parent or legal guardian will be directed to follow the instructions provided in the confirmation email. Your parent or legal guardian will then be asked to complete & submit an online registration form & upload your video to the following Contest topic ("topic"): I'm the perfect kid to go On Assignment at Camp Hyatt as an honorary reporter because __________________. I'd report back on the Camp Hyatt located in __________________ because I'd like to learn about __________________ & participate in __________________ Camp Hyatt activities there. Visit camphyatt.com for a list of Camp Hyatt locations & activities. Video must be between one (1) minute & two (2) minutes long featuring entrant & his/her original video content. Video file size cannot exceed 100MB & must be submitted in one of the following formats: AVI, MOV, MP4, MPEG, or FLV. See Judging Section below to make sure that your video submission & Entry Information (collectively, "Entry") complies with the video requirements set forth herein, & includes all elements on which Entries will be judged. Your parent or legal guardian will be sent confirmation once the Entry is uploaded & submitted successfully. By entering you into the Contest online, your parent or legal guardian will automatically be sent an email concerning your status in the Contest. If your parent or legal guardian does not consent to your participation in the Contest, all Entry Information will be deleted. In the event of a dispute as to the identity of an entrant, entrant will be deemed the individual named on the online pre-registration form, regardless of whether that individual is the authorized account holder of the email address at issue provided that person meets all eligibility criteria set forth in these Official Rules. By submitting an Entry in the Contest, entrant’s parent or legal guardian hereby warrants & represent that your entry conforms to the Entry Requirements set forth herein, including the following Entry Requirements:
Parent or legal guardian consent is required as described above, & no Entry will be submitted or accepted unless & until entrant's parent or legal guardian provides his/her approval as set forth in these Official Rules. Entry must be entrant's original, personal creation, in English. Modification of an existing work does not qualify it as original. Limit (1) Entry per person per email address during the entire Promotion Period, regardless of the number of email addresses or method of entry used. In case of multiple Entries from any one person, only the first Entry received will be accepted & all subsequent Entries received from such person will be void. In the event of non-compliance with any requirements specified herein, Entry will be void. The use of script, macro or automated or mechanical devices (or any other devices intended to automate or subvert any aspect of Entry or mechanically reproduce Entries) to enter Contest is prohibited & any use of automated devices will cause disqualification. Entries that are deemed to be ineligible (at Sponsor’s sole discretion & in accordance with these Official Rules) are void. Released Parties are not responsible for lost, incomplete, late, stolen, garbled, delayed, illegible, unintelligible, inaccurate, incomplete or misdirected forms, Entries, videos, submissions or emails; telephonic, human or computer failures, problems or errors; interruptions in service due to system upgrades, repairs, modifications or other causes; failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems; traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Entries, videos, or mail or the announcement of the prize, the cancellation of any on-site event, or for any injury or damage to participant’s or any other person's computer relating to or resulting from participation in this Contest, or for printing, typographical, mechanical, electronic, network, human or other errors appearing in these Official Rules or other Contest-related materials. Sponsor reserves the right, in its sole discretion, to void any Entries of entrants (& disqualify such entrants) whom Sponsor believes, in its sole discretion, have attempted to tamper with or impair the administration, security, fairness or proper play of this Contest or is in violation of these Official Rules. Your parent or legal guardian’s submission of an Entry constitutes their representation of your eligibility, consent to participate in the Contest & consent for Sponsor to obtain, use, & transfer your name & other information solely for the purpose of Contest administration. Entrants' personally identifiable information will only be used as described herein. Please see the privacy policy located at http://www.hyatt.com/hyatt/customer-service/privacy-policy.jsp for details of Sponsor's policy regarding the use of personal information collected in connection with this Contest. Entries become property of the Sponsor, & none will be returned.
BY SUBMITTING AN ENTRY, ENTRANT’S PARENT OR LEGAL GUARDIAN ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE, IN SPONSOR’S DISCRETION. Submission of an Entry grants Sponsor & its agents an unlimited, worldwide, perpetual, license & right to publish, use, publicly perform the Entry in any way, in any & all media, without limitation, & without consideration to the entrant. ENTRIES POSTED TO THE WEBSITE WERE NOT EDITED BY SPONSOR & ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT & DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. By submitting an Entry, entrant's & entrant's parent or legal guardian agrees that entrant's submission is gratuitous & made without restriction, & will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to entrant and/or entrant's parent or legal guardian. Entrant's && entrant's parent or legal guardian acknowledge that, by acceptance of entrant's submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than entrant.
Judging: (1) Potential prize winner will be determined on or about 9/21/09 from among all eligible Entries received, based on the following criteria: 1) Originality: Is your Entry fun, different, & does it show us a bit about you? 0-5 points; 2) Presentation: Did you appear to be having fun while creating your video about the topic? Does that show in how you act & how you share your desire to be On Assignment? 0-5 points; 3) Description of Camp Hyatt & Activity: Did you tell us about the Camp Hyatt you want to visit, why & what you would learn there? 0-5 points; & 4) Relevance to Topic: 0-5 points. The official judging panel will consist of qualified independent judges selected by Sponsor whose decisions will be final & binding in all matters relating to this Contest. In the event of a tie, tie breaker will be based upon the highest score in the first judging criteria, continuing thereafter to each judging criteria in order, as needed, to break the tie. Sponsor reserves the right to edit Entry for online posting & other use as it deems necessary in its sole discretion & entrant (& the parent or legal guardian of the entrant) acknowledges & agrees that Released Parties shall not be responsible for any alleged consequences of such editing and/or posting. The parent or legal guardian of the winning entrant will be notified by telephone and/or overnight mail on or about 10/5/09.
(1) Grand Prize: Trip for winner & up to three (3) members of his/her immediate family to the Hyatt of winner's selection in the U.S. or the Caribbean. Trip includes round-trip coach air transportation for winner & three (3) guests from major commercial airport near winner's residence within the U.S. to airport nearest to Hyatt of winner's selection in the U.S. or Caribbean, one (1) standard quad-occupancy hotel accommodation at the selected Hyatt (room & tax only) awarded in the form of Hyatt Stay Certificates for six (6) days/five (5) nights, & an opportunity for the winner (minor child) to participate in Camp Hyatt activities of his/her choice during his/her stay & journal his/her experience as the honorary On Assignment reporter for potential features on camphyatt.com and/or other websites or publications as designated by Sponsor (Approximate Retail Value "ARV"=$4,000). Actual prize value may vary based on location of winner's residence & final trip itinerary. Any difference between stated approximate retail value & actual value of Prize will not be awarded. Trip must be taken on dates approved by Sponsor & be completed no later than 8/30/10 or prize will be forfeited in its entirety. Travel & accommodation restrictions & other restrictions and/or black out dates may apply. Hyatt Stay Certificate subject to terms & conditions set by issuer. Winner & guests must travel together on same itinerary & are responsible for obtaining all required travel documents (e.g., a valid U.S. driver's license or passport) required for travel. All travel arrangements must be made through an agent of Sponsor's selection, on an air carrier of Sponsor's choice. Released Parties are not responsible for travel delays or cancellations. Winner & guests must comply with all Camp Hyatt rules & regulations. Costs & expenses associated with the acceptance & use of the prize not specified herein as being awarded, including, but not limited to, all taxes, & food, beverages, gratuities, luggage fees, ground transportation & miscellaneous travel expenses are the sole responsibility of the winner's parent or legal guardian.
Miscellaneous: No transfer, assignment, cash redemption or substitution of prize (or portion thereof) except by Sponsor at its sole discretion, which reserves the right to substitute the prize (or applicable portion thereof) with one of comparable or greater value. Prize will be awarded in the name of the Grand Prize winner's parent or legal guardian who will be required to take minor winner on the trip as one of his/her guests. Potential Grand Prize winner's parent or legal guardian will be required to execute & return a notarized Affidavit of Eligibility, Liability & (where legal) Publicity Release within (14) days of date of issuance of notification. Each guest (if a minor, his/her parent or legal guardian) will also be required to sign & return a notarized Liability Release & (where legal) Publicity Release prior to the ticketing & booking of travel occurs. Any minor guest must be accompanied on trip by his/her parent or legal guardian as a guest. Minors must be accompanied at all times during trip (including, but not limited to, in-flight, hotel stay & all prize-related events) by minor's parent or legal guardian. By participating, entrant & his/her parent or legal guardian agree to abide by these Official Rules & the decisions of the Sponsor & judges, which shall be final & binding. Non-compliance with the foregoing or with these Official Rules may result in disqualification. By submitting an Entry, entrants & their parents or legal guardians warrant & represent that it: (1) is the entrant's original work; (2) has not been previously published; (3) has not won previous awards; (4) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (5) that you have obtained permission from a person who's name, likeness or voice is used in the video; (6) that publication of the video via various media including Web posting, will not infringe on the rights of any third party rights; & (7) is the true & accurate opinion of the entrant. Any such entrant & entrant's parent or legal guardian will indemnify & hold harmless, Sponsor & Released Parties from any claims to the contrary. Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor's use of such entry, in a form satisfactory to administrator, upon request, prior to award of prize and/or naming of entrant as a winner.
By accepting the prize, the winner & winner's parent or legal guardian agrees that winner's Entry will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner & winner's parent or legal guardian irrevocably assigns & transfers to Sponsor all of winner's right, title & interest in & to winner's video, including all but not limited to all copyright & trademark rights which he or she may have, in the United States & worldwide, therein, for consideration, the receipt & sufficiency of which is hereby acknowledged. Winner & winner's parent or legal guardian hereby waives in favor of Sponsor, all rights of "Droit Moral" or "Moral Rights of Authors" or any similar rights or principles of law that winner may now or later have to his/her Entry. Sponsor reserves the right to alter, change or modify the winning Entry, in its sole discretion. Upon request of Sponsor, winner's parent or legal guardian shall execute & deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title & interest in & to the Entry & of the copyrights transferred & "Moral Rights of Authors" waived under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights & Sponsor may at a later time request the assignment. Further, Sponsor may request from winner’s parent or legal guardian, that the winner and/or winner's parent or legal guardian secure from any model(s) or videographer an irrevocable assignment & transfer to Sponsor all of any model(s) or videographer's right, title & interest in & to the winner's Entry, including all but not limited to all copyright & trademark rights which he or she may have, in the United States & worldwide, therein, for consideration, the receipt & sufficiency of which is hereby acknowledged. The model(s) or videographer may be required to waive in favor of Sponsor, all rights of "Droit Moral" or "Moral Rights of Authors" or any similar rights or principles of law that the model(s) or videographer may now or later have in the Entry. Should Sponsor fail to request the said model(s) assignment or videographer assignment as stated, that shall not be deemed a waiver of Sponsor's rights & Sponsor may at a later time request the assignment(s).
Entrant & entrant's parent or legal guardian agree that Sponsor & its designees & assigns: (a) shall have the perpetual, worldwide right to edit, publish, exploit & use Entry (or any portion thereof) in any way & in any media for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification from/to entrant, winner, parents or legal guardians, or any 3rd Party; (b) shall have the right & permission (unless prohibited by law) to use each entrant's name, voice, city/state of residence, video, biographical information, photograph and/or other likeness for advertising, trade and/or for any other purpose in any media or format, online and/or offline, now or hereafter known, worldwide in perpetuity, without further compensation, permission or notification; (c) shall have no liability & entrant & his/her parent or legal guardian will defend, indemnify & hold harmless Released Parties from & against any liability, loss, injury or damage of any kind (including attorney’s fees) to any person or entity including, without limitation, personal injury, death or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or participation in Contest & any travel related thereto including, but not limited to, any claim for personal injury or damage to or loss of personal property or any claim that materials infringe or violate the rights of any person or entity. Sponsor reserves the right, in its sole discretion, to modify, terminate or suspend Contest should any non-authorized intervention or causes (including but not limited to threats of terrorist activity, inability to secure any prize component, labor strikes, and/or acts of God) corrupt or impair the administration, security, fairness, judging, or proper play of Contest &, if Contest is terminated or suspended, at its discretion, randomly award the prize from among all non-suspect, eligible Entries received prior to suspect event requiring such modification, termination, or suspension.
CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Contest is a violation of criminal & civil laws & should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys' fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
By submitting an Entry, entrants & their parents or legal guardians agree that all issues & questions concerning the construction, validity, interpretation & enforceability of these Official Rules, entrant's and/or entrant's parent or legal guardian's rights & obligations, or the rights & obligations of the Sponsor in connection with the Contest, shall be governed by, & construed in accordance with, the laws of State of Illinois, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction & venue of the federal, state & local courts located in Cook County, Illinois.
